By accessing www.foodwinenet.com, users agree to abide by the terms and conditions outlined below. Anyone not accepting these terms and conditions in their entirety shall not be entitled to use the service.

General
By accessing www.foodwinenet.com, a Customer commits his/herself to abiding by its Terms and Conditions of Use. Any Customer not accepting the Terms and Conditions of Use in their entirety shall not be entitled to use the Service.
In the event that the conditions covering a particular section of the Service conflict with these Terms and Conditions, precedence shall be given to the conditions governing that section.

Changes in the Terms and Conditions and the Service

FoodWineNet.com shall be entitled to amend its Terms and Conditions, and will announce any substantive changes on FoodWineNet.com Web site and/or communicate information on them by email or via the Service to registered customers. Changes shall come into force as of the date stated. By continuing to make use of the Service after changes have been made to the Terms and Conditions, a Customer shall commit him/herself to abide by the amended conditions.
FoodWineNet.com  will strive to develop the Service and ensure that it operates with the minimum of disruption or interruption. FoodWineNet.com shall be entitled to change or remove its content or parts of it, its structure, periods of service, or other aspects of the Service. In the event that such changes require changes in a Customer’s hardware or software or other actions on the part of the Customer, FoodWineNet.com shall strive to inform the Customer of these issues in advance and in good time. The Customer shall be responsible for any costs associated with his/her hardware or software required by such changes.

Provision and use of the Service

i. Provision of the Service
In principle, the Service shall be available 24 hours a day, unless a specific time window is given for a particular service. FoodWineNet.com does not provide any direct or indirect guarantees regarding the operation of the Service or aspects of the Service, and does not guarantee that the Service will operate without interruption or any problems. FoodWineNet.com shall always be entitled, if it so wishes, to terminate provision of the Service or part of it, or to withdraw the Service or part of it temporarily for maintenance or some other reason, without any liability to provide compensation.
FoodWineNet.com shall be entitled to prevent any use of the Service or remove any material that conflicts with the law, good practice, or the rights of third parties, or that has a negative impact on or places an unreasonable load on the Service or the network, threatens data safety or data protection, has a negative impact on users of the Service, other third parties, or FoodWineNet.com, or is otherwise in conflict with the Terms and Conditions of Use, any special provisions, or other aspects of use of the Service. Where it considers it appropriate, FoodWineNet.com can also prevent a Customer accessing the Service and/or receiving the Service without giving any advance warning.

ii. Use of the Service
The Customer shall have a limited right of use of the Service as set forth in these Terms and Conditions. The Customer shall receive and use the Service at his or her own risk.
The Customer shall be responsible for procuring his or her own hardware, software, and Internet connection necessary for using the Service, and for installing, maintaining, and running this. The Customer shall not link or use the Service in such a way as to impose an unreasonable load on or create other problems for the network, other networks connected to the Internet, other users of the Service, other third parties, or FoodWineNet.com. FoodWineNet.com can provide detailed instructions regarding usage that may overload the network and information on forbidden types of usage.
Usage of some sections of the Service may require registration.

iii. Personal identification information

Any personal identification information provided to the Customer by FoodWineNet.com, such as user names and passwords, shall remain the property of FoodWineNet.com, and the Customer shall not be entitled to use them after his/her right to use the Service ends. Identification information of this type is customer-specific and the Customer shall not pass it on to third parties or inform third parties about them. The Customer shall be responsible for all usage of the Service made using his or her personal identification information.
If personal identification information is lost or falls into the hands of third parties that are not entitled to it, the Customer shall inform FoodWineNet.com’s Customer Service Department without delay. FoodWineNet.com shall be entitled to close a Customer’s access to the Service in such an event.
FoodWineNet.com shall be entitled to change personal identification information if required to do so for reasons related to the network, the Customer, provision of the Service, data security or protection, official requirements, or other reasons.

Paid services and invoicing
The basic services provided by the FoodWineNet.com are free of charge to the Customer. The Service also contains areas that require payment. In addition, various products requiring payment can also be ordered through the Service. The prices of such services and products, and the terms and conditions covering payment for them, shall be stated in connection with each of the services and products concerned. FoodWineNet.com shall be entitled to amend the prices and invoicing rules used as part of the Service where it considers this appropriate, by announcing such changes on the Service or via any other appropriate means in good time in advance of their coming into force. Unless otherwise stated in respect of a particular service, changes shall be announced a minimum of one (1) month before they come into force. If the value-added tax or some other tax or official charge applicable to the Service changes, or the rules used to apply such taxes or charges change, FoodWineNet.com shall be entitled to amend its prices appropriately with immediate effect.

Responsibility for the Service and liability for damages

i. FoodWineNet.com’s liability
FoodWineNet.com shall not be liable for any indirect damage that could be caused to the Customer. For the avoidance of any doubt it is stated that FoodWineNet.com shall not be responsible for or liable for damage resulting from incorrect operation of the Service, interruptions in service, anything preventing the Customer from using the Service, errors in the Service, shortcomings in the Service, or termination of the Service or any of its sections that might affect the Customer, or for failures or problems affecting the Customer’s hardware or software.
FoodWineNet.com shall not be responsible for the content of the Service or any other content that is provided or is accessible through the Service, or its reliability.
FoodWineNet.com shall not be liable for any damage resulting from a force majeure event or other similar event which unreasonably complicates operation.
A Customer shall be required to claim compensation from FoodWineNet.com within one month of noticing or being in a position to notice a problem that entitles the Customer to compensation. In respect of Paid Services, FoodWineNet.com’s liability for any and all damage shall be limited to the sum paid by the Customer for the service in question for the period concerned.

ii. Customer liability
The Customer shall be responsible for his/her use of the Service and for material supplied to the Service or supplied to other users and other networks via the Service, and for ensuring that use of the Service and the material mentioned above does not infringe the copyright, industrial property rights, or other rights of third parties, or conflicts with the Terms and Conditions of Use of the Service or any of the terms covering separate sections of the Service or is not contrary to the law or good practice, or does not cause damage to or problems for the network, FoodWineNet.com, FoodWineNet.com’s contractual partners, other users of the Service, or other third parties. The Customer shall be required to compensate FoodWineNet.com or any relevant third parties for any damage caused to them.

Data protection

i. Data security
The Customer should be aware of the data security risks associated with using unencrypted data networks. FoodWineNet.com shall strive to ensure the security of its data systems using generally accepted methods and prevent unauthorised access to its data systems.
FoodWineNet.com shall not be responsible for the Customer’s data security when using the Service. The Customer shall be responsible for protecting the computers, systems, networks, or other equivalent equipment or systems that he/she uses. The Customer shall be responsible for the consequences of inadequate protection and liable for any damage caused to FoodWineNet.com, users, or third parties resulting from viruses or other problems of a similar nature entering the network or spread through the network as a result of the Customer’s action.

ii. Handling of personal information
Personal information shall be processed and registered in accordance with the requirements of the legislation governing this type of information. Customers registered with the Service will be included in FoodWineNet.com’s customer register, and the information recorded there and provided by the Customer during registration or otherwise may be used for checking the identity of the Customer, maintaining normal customer relations, other activities of a similar nature related to the Service, and direct marketing. iii. Cookies
Usage of the Service requires the Customer to permit the use of cookies. The latter will be transferred to the Customer’s computer from time to time to monitor use of the Service and enhance data security for the Customer. Cookies are used to collect information on how and when the Service is used, to analyse and develop the Service to provide the Customer with a better offering. The statistic information can also be used by the provider of the Service and its partners to monitor the number of people using the Service.
In addition, the site also contains advertising from third parties (including Google). These third parties may use cookies to tailor their advertising by collecting information on the Customer’s visits to this and other sites. Third parties use information collected by the use of cookies to generate targeted advertising based on the Customer’s interests. Further information on the targeted advertising used by Google and instructions on how to prevent the use of Google cookies can be found via the following link: http://www.google.fi/privacy_ads.html. The Customer can always prevent the use of cookies by modifying the preferences of his/her browser to prevent cookies being downloaded.

Duration of user rights

i. Restriction of user rights
FoodWineNet.com shall be entitled to restrict or prevent use of the Service as described in these Terms and Conditions.

ii. Issues following the ending of user rights

Even after the ending of user rights, the Customer shall remain covered by the rights of ownership and copyright contained in these Terms and Conditions, the liability for damages specified here, and the limits placed on liability detailed here.

Disagreements
FoodWineNet.com and the Customer shall strive to resolve any disagreements between them through negotiation. In the event that the parties cannot agree, the issue shall be put before the Helsinki District Court. The Customer can also bring a case in the equivalent lower court of the judicial district in which he or she lives if he or she so wishes.

Other matters

i. Transfer of user rights
The Customer shall not be entitled to transfer his/her right to use the Service to a third party without the prior written consent in advance of FoodWineNet.com. FoodWineNet.com shall be entitled to transfer the Service and its maintenance, together with the Service’s customers, to a third party by informing the Customer of the transfer. FoodWineNet.com shall not be required to inform the Customer in advance if such a transfer is made to another company within the same group.

ii. Validity of these Terms and Conditions

These Terms and Conditions came into force as of 31.10.2010 and shall remain in force until further notice. They shall apply to customers who joined the Service prior to this date and replace the previous terms and conditions covering FoodWineNet.com’s Internet services.

iii. Consumer protection and other legislative issues
These Terms and Conditions do not limit the rights of the Customer under consumer protection or other legislation.

iv. Customer assurance
The Customer shall confirm that that the information he/she provides is correct and up-to-date and that he/she has familiarised him/herself with the Terms and Conditions of Use and other terms and conditions covering sections of the Service. The Customer shall agree to abide by all the terms and conditions referred to above when using the Service.
